1. About Us

These Terms of Service govern your use of the services provided by The Original Bingo & Trivia Company ("we", "us", "our"), a Melbourne-based entertainment company operating across Victoria and interstate. Our services include trivia nights, bingo events, karaoke shows, corporate entertainment, and fundraising events.

By making an enquiry, confirming a booking, or using our website at bingoandtrivia.com.au, you agree to these terms.

2. Bookings and Confirmation

All bookings are subject to availability and are not confirmed until you receive a written confirmation from us. A booking is considered confirmed when:

• You have received a written confirmation email from us
• A deposit or full payment has been received where required
• You have agreed to the event details including date, time, venue, and format

We reserve the right to decline any booking at our discretion.

3. Pricing and Payment

All prices are quoted in Australian dollars (AUD) and are inclusive of GST unless otherwise stated. Pricing is based on the event details agreed at the time of booking including format, duration, guest numbers, and location.

• A deposit may be required to secure your booking date
• Full payment is due by the date specified in your invoice
• Late payments may incur an administration fee
• Prices are subject to change for future bookings but will not change once a booking is confirmed in writing

Accepted payment methods will be communicated at the time of invoicing.

4. Cancellations and Refunds

We understand that plans can change. Our cancellation policy is as follows:

• More than 14 days before the event: Full refund of any deposit paid, minus any non-recoverable costs already incurred
• 7 to 14 days before the event: 50% of the total booking fee is payable
• Less than 7 days before the event: 100% of the total booking fee is payable
• Cancellation on the day: Full fee applies with no refund

All cancellations must be made in writing via email to info@bingoandtrivia.com.au. Cancellation fees may be waived or reduced at our discretion in exceptional circumstances such as serious illness or natural disaster.

5. Postponements and Rescheduling

We will make reasonable efforts to accommodate rescheduling requests subject to availability. Rescheduling requests made less than 7 days before the event may be treated as a cancellation at our discretion. A rescheduling fee may apply for last-minute changes.

6. Client Responsibilities

To ensure a successful event, the client agrees to:

• Provide accurate event details including guest numbers, venue address, and any special requirements at the time of booking
• Ensure the venue is available, accessible, and suitable for the agreed event format
• Provide adequate space, power access, and equipment as outlined in our event requirements
• Notify us promptly of any significant changes to guest numbers or event details
• Ensure all guests behave respectfully toward our hosts and staff
• Obtain any necessary permits or approvals required by the venue or local authorities

7. Our Responsibilities

We agree to:

• Provide a professional, experienced host for your event as agreed
• Arrive on time and prepared with all necessary equipment and materials
• Deliver the agreed format, duration, and content to the best of our ability
• Communicate promptly and professionally throughout the booking process
• Provide a substitute host of equal quality in the unlikely event your assigned host is unable to attend

8. Force Majeure

Neither party shall be held liable for failure to perform their obligations where such failure is caused by circumstances beyond their reasonable control, including but not limited to natural disasters, pandemic restrictions, extreme weather, power outages, or government-imposed restrictions. In such cases, we will work with you to reschedule the event where possible.

9. Intellectual Property

All trivia questions, bingo content, game formats, scripts, and materials used in our events are the intellectual property of The Original Bingo & Trivia Company. You may not reproduce, record, distribute, or commercialise any of our content without prior written permission.

You grant us permission to photograph or record portions of our events for promotional purposes unless you notify us otherwise in writing prior to the event.

10. Limitation of Liability

To the maximum extent permitted by Australian law, our total liability to you for any claim arising from our services is limited to the amount you paid for the specific event giving rise to the claim.

We are not liable for any indirect, special, incidental, or consequential loss or damage including loss of profit, loss of revenue, or damage to reputation arising from our services or any failure to provide services.

Nothing in these terms excludes any rights you may have under the Australian Consumer Law.

11. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services remedied if they fail to be of acceptable quality.

12. Website Use

You may use our website for lawful purposes only. You must not:

• Use the website in any way that breaches applicable laws or regulations
• Transmit unsolicited commercial communications
• Attempt to gain unauthorised access to any part of our website or systems
• Use automated tools to scrape or extract data from our website

We reserve the right to restrict access to our website at any time without notice.

13. Privacy

Your personal information is collected and handled in accordance with our Privacy Policy, which forms part of these Terms of Service.

14. Changes to These Terms

Bookings already confirmed will be governed by the terms in place at the time of confirmation.

15. Governing Law

These Terms of Service are governed by the laws of Victoria, Australia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Victoria.
